1. Introduction and Acceptance

These Terms and Conditions govern your access to and use of the website, communications, estimates, scheduling tools, and related services offered by Heritage Summit Roofing. By visiting our website, requesting an estimate, submitting a form, calling or emailing us, scheduling an inspection, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you should not use our website or request services from us.

These Terms are effective as of 2026-05-22 and apply to all users, including homeowners, property managers, business customers, general contractors, vendors, and visitors. In these Terms, “we,” “us,” and “our” refer to Heritage Summit Roofing, and “you” refers to any person or entity accessing our website or engaging with our services.

Our website and communications may include general information about roofing, inspections, repairs, replacements, maintenance, storm damage, gutters, ventilation, materials, warranties, financing options, insurance claim support, and related exterior services. This information is provided for general informational purposes only and does not replace a written proposal, contract, inspection report, professional judgment, or applicable building code requirements.

2. Services and Estimates

Heritage Summit Roofing provides roofing-related services that may include roof inspections, roof repair, roof replacement, leak investigation, storm damage assessment, emergency response, maintenance, gutter-related services, ventilation evaluation, and other exterior improvement services. The exact scope of any work will be described in a written estimate, proposal, work authorization, or service agreement provided to you.

Any estimate, quote, or pricing information provided through our website, by phone, by email, or during an initial consultation is preliminary unless and until confirmed in a written agreement signed or accepted by the parties. Pricing may depend on site conditions, accessibility, roof pitch, material availability, code requirements, permitting, structural issues, hidden damage, weather conditions, labor needs, disposal requirements, and other factors that may not be apparent until inspection or work begins.

We may recommend additional work if we discover unsafe conditions, rotten decking, inadequate ventilation, code deficiencies, moisture intrusion, improper prior installation, structural issues, or other conditions affecting the performance or safety of your roof. You are responsible for reviewing all estimates, asking questions before approval, and ensuring that the described scope meets your needs.

We reserve the right to decline, suspend, or discontinue services where conditions are unsafe, access is inadequate, required approvals are unavailable, payment terms are not met, or the requested work is outside our licensing, insurance, capacity, or professional judgment.

3. Your Responsibilities

You agree to provide accurate, complete, and current information when contacting us, requesting services, or submitting forms. This may include your name, contact information, property address, project details, insurance information if applicable, access instructions, and information about known leaks, prior repairs, structural conditions, or safety hazards.

You are responsible for ensuring that you have the authority to request services at the property. If you are a tenant, property manager, contractor, agent, or representative, you confirm that you have permission from the owner or other authorized party to request inspections, estimates, or work.

Before scheduled work begins, you agree to provide safe and reasonable access to the property, including driveways, gates, attic access where applicable, electrical outlets if needed, and areas around the structure. You should move vehicles, outdoor furniture, fragile items, valuables, pets, and other property away from work areas. Roofing work may involve noise, vibration, falling debris, dust, nails, materials, and temporary disruption. You are responsible for informing household members, tenants, employees, customers, neighbors, or other affected persons as appropriate.

You agree not to misuse our website or services. Prohibited conduct includes submitting false information, attempting unauthorized access to systems, interfering with website functionality, copying content for commercial use without permission, using our services for unlawful purposes, or engaging in abusive, threatening, fraudulent, or deceptive conduct toward our personnel or representatives.

4. Website Content and No Professional Guarantee

The content on our website is intended to describe our company, services, and general roofing topics. While we strive to keep information accurate and useful, we do not guarantee that website content is complete, current, error-free, or suitable for every property or situation. Roofing conditions vary widely, and decisions should be based on an on-site evaluation and written documentation specific to your property.

Product colors, shingle styles, roof systems, warranty terms, and availability may vary by manufacturer, supplier, location, and installation conditions.

Any advice or recommendation is subject to inspection, applicable law, building code requirements, manufacturer specifications, and the final written scope of work.

5. Scheduling, Weather, Permits, and Site Conditions

Scheduling is subject to availability, weather, material delivery, labor coordination, permitting, inspections, safety considerations, and other operational factors. Roofing work is particularly affected by rain, wind, extreme heat, lightning, supply delays, and unforeseen site conditions. We may reschedule inspections or work when conditions make performance impractical, unsafe, or likely to compromise quality.

Where permits, approvals, association consents, historic district approvals, or municipal inspections are required, responsibility will be allocated in the applicable written agreement. You are responsible for identifying any homeowner association rules, deed restrictions, landlord requirements, building access limitations, parking restrictions, or other property-specific obligations that may affect the work.

Hidden or unforeseen conditions may require changes to the scope, schedule, or price. Examples include deteriorated decking, mold-like growth, moisture damage, insect damage, inadequate framing, concealed layers, improper flashing, code-required upgrades, asbestos-containing materials, or unsafe electrical or structural conditions. We will use reasonable efforts to communicate material changes and obtain required approvals before proceeding with additional work, except where immediate action is reasonably necessary to protect safety or property.

6. Payments, Deposits, Change Orders, and Collections

Payment terms will be stated in the applicable estimate, proposal, invoice, or service agreement. Depending on the project, we may require a deposit, progress payments, payment upon material delivery, payment upon substantial completion, or other agreed terms. You agree to pay all amounts due in accordance with the applicable written terms.

Changes to the agreed scope of work may require a written or otherwise documented change order, and may affect price, materials, schedule, warranties, and completion dates. Verbal requests made to field personnel may not be binding unless confirmed by an authorized representative of Heritage Summit Roofing.

If payment is late, we may suspend work, withhold final documentation to the extent permitted by law, charge late fees or interest where allowed and disclosed, recover collection costs, and pursue available legal remedies. You are responsible for reasonable costs of collection, including attorney fees, court costs, filing fees, and related expenses, to the extent permitted by applicable law or contract.

If a project involves insurance proceeds, you remain responsible for payment under your agreement with us regardless of the timing or amount of any insurance payment, unless a written agreement expressly states otherwise. We do not guarantee claim approval, coverage determinations, supplement approval, depreciation release, or payment by an insurer.

7. Insurance Claim Assistance

We may provide factual information, photographs, measurements, estimates, or damage observations to assist you in communicating with your insurance carrier. Any such assistance is provided as a customer service and does not make us your public adjuster, attorney, insurance broker, or representative unless specifically permitted by law and agreed in writing.

You are responsible for reviewing your insurance policy, complying with policy deadlines, communicating with your insurer, paying deductibles, and making final decisions regarding claims. We do not interpret policy coverage, negotiate claims in a manner reserved to licensed professionals, or provide legal advice. Insurance carriers make their own coverage and payment decisions, and we are not responsible for denial, delay, underpayment, or conditions imposed by your insurer.

You agree not to ask us to waive, rebate, absorb, conceal, or misrepresent a deductible or any material fact in connection with an insurance claim. We may refuse to participate in conduct that we believe is unlawful, misleading, unsafe, or inconsistent with industry standards or ethical business practices.

8. Warranties and Manufacturer Materials

Any workmanship warranty offered by Heritage Summit Roofing will be stated in the written agreement or warranty document applicable to your project. Warranty coverage, exclusions, claim procedures, duration, and remedies may vary by service type and scope. No warranty is created by general website statements unless expressly included in a written warranty issued by us.

Manufacturer warranties for shingles, underlayment, flashing components, vents, coatings, gutters, fasteners, or other materials are provided by the applicable manufacturer, not by Heritage Summit Roofing. Manufacturer warranties are subject to the manufacturer’s terms, exclusions, registration requirements, transfer rules, ventilation requirements, installation specifications, and claim procedures.

Warranties may be limited or void if damage results from improper maintenance, foot traffic, third-party work, structural movement, storms, hail, wind, falling objects, animals, pests, fire, vandalism, owner modifications, clogged gutters, inadequate ventilation not included in our scope, pre-existing conditions, or other causes outside our control. Your written warranty documents, if any, will control over general descriptions on the website.

9. Intellectual Property and Website Use

All content on our website, including text, graphics, logos, service descriptions, photographs, layouts, icons, and other materials, is owned by or licensed to Heritage Summit Roofing and is protected by copyright, trademark, and other intellectual property laws. You may view and use the website for personal, non-commercial purposes related to evaluating or requesting our services.

To the fullest extent permitted by law, our total liability for claims arising from or related to website use will not exceed one hundred U.S. dollars. For claims arising from contracted services, liability will be governed by the applicable written agreement and applicable law. Nothing in these Terms limits liability that cannot legally be limited, including liability for intentional misconduct or other non-waivable rights under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Heritage Summit Roofing, its owners, officers, employees, contractors, representatives, suppliers, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising out of or related to your breach of these Terms, your misuse of the website, your submission of inaccurate information, your violation of law, your violation of third-party rights, or unsafe or undisclosed conditions at a property under your control.

This indemnification obligation does not apply to the extent a claim is caused by our own gross negligence, willful misconduct, or other conduct for which indemnification may not be required under applicable law. We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate reasonably with that defense.

12. Governing Law, Disputes, and Contact Information

These Terms, and any dispute arising from or related to your use of our website or services, are governed by the laws of the State of Texas and applicable federal law, without regard to conflict of law principles. Unless a written agreement provides otherwise, you agree that courts located in Dallas County, Texas, will have venue and jurisdiction over disputes that are not subject to another required forum.

Before filing a claim, you agree to contact us and provide a reasonable description of the issue so the parties can attempt to resolve the matter informally. We value customer satisfaction and will make reasonable efforts to review concerns regarding scheduling, workmanship, billing, communication, or website use. This informal process does not prevent either party from seeking urgent relief where necessary to protect property, safety, confidential information, or legal rights.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted to the maximum extent permitted by law. Our failure to enforce any provision is not a waiver of our right to enforce it later. We may update these Terms from time to time by posting a revised version with a new effective date. Continued use of the website or services after updates means you accept the revised Terms.
